Child Victims Act
Victims of child sexual abuse who were unable to pursue their claims -- or were unaware of their right to seek damages for their injuries -- have recently been given a reprieve by New York State. Under the newly-enacted Child Victims Act (CVA), there is now more time for survivors of child sexual abuse to press criminal charges. In addition, the CVA extends the period of time during which a survivor of child sexual abuse can file a claim for money damages. These claims may be filed against individuals and against private or public institutions that permitted the abuse through negligence or intentional violations.
The CVA helps survivors of child sexual abuse by extending the statute of limitations for civil claims so that those whose claims are still within the statute of limitations period can pursue legal action until they are 55 years old.
And critically, the CVA also grants survivors of child sexual abuse who missed the deadline to file a civil case a one year amnesty or “look back” period available to do so, starting on August 14, 2019.
